Senate Bill 1194 Public Restrooms: Building Standards

The City of West Hollywood applauds California Governor Gavin Newsom for signing into law Senate Bill 1194 Public Restrooms: Building Standards (SB 1194 – Allen). SB 1194 permits gender-neutral multi-cabin bathrooms in cities that choose to adopt such an ordinance.

On February 17, 2022, Senator Ben Allen (D-Santa Monica) introduced SB 1194. On Tuesday, August 30, 2022, the California State Senate approved the bill by a vote of 70 to 0, after it passed by the California State Assembly on Monday, August 29, 2022 in a 54-0 vote. Governor Newsom signed into law the bill on September 29, 2022, allowing cities to adopt the new regulations for gender-neutral multi-stall bathrooms by passing ordinances. Additionally, and to provide additional discretion to communities, cities may exclude certain occupations from the requirements of the bill. “I’m glad the Governor signed SB 1194 into law!” said City of West Hollywood Mayor Pro Tempore Sepi Shyne. “I was proud to co-sponsor the City of West Hollywood’s multi-cabin gender-neutral bathroom ordinance, which made us the first city in the United States to mandate fairness and safety. in access to bathrooms for people with disabilities who have opposite-sex caregivers, our transgender, non-binary, and gender-nonconforming siblings, and gay and single parents of children of the opposite sex. worked with Senator Ben Allen and his team, my fellow council member John M. Erickson and our city legislative team to help guide SB 1194 through the Legislature California is now the first state in the nation to give local control cities to make the same choice as West Hollywood.

It highlights the critical work the City of West Hollywood is doing to strengthen our commitment not only to the LGBTQ community, but also to people with disabilities and people with children of the opposite sex who all want to make it easier to use the restroom.” said West Hollywood City Councilman John M. Erickson. “SB 1194 is common-sense legislation that gives local municipalities the ability to choose to create gender-neutral bathrooms and allows businesses to continue their commitment to creating open and safe spaces for all. I am extremely grateful to Senator Ben Allen for drafting this important legislation, to the co-authors and supporting organizations, and proud to have originally presented this article here in West Hollywood with my colleague, Mayor Pro Tempore Sepi Shyne.

The City of West Hollywood and the City of Santa Monica were primary sponsors of Senate Bill 1194 Public Restrooms: Building Standards (SB 1194 – Allen); Equality California, the Los Angeles LGBT Center and The [email protected] Coalition were the sponsors; and ACLU California Action and Disability Rights California supported the bill.

As a backdrop, in 2014, the city of West Hollywood was the first city in California to require single stall restrooms to be designated gender neutral. In 2016, the California State Legislature followed suit by approving Assembly Bill (AB) 1732. On May 3, 2021, the West Hollywood City Council approved an article asking the staff to prepare an ordinance requiring newly constructed public accommodations and those undergoing major renovations to incorporate gender-neutral multi-cabin bathrooms.
